If you have been injured in an accident you might want to consider hiring an accident attorney. The main thing that you want to look for when choosing an accident attorney is that they have your best interests at heart. With accident attorneys, you need to be careful because there are many frauds out there. These people claim that they are attorneys, but are not accredited lawyers, all that they are concerned with is extorting large amounts of money from people or companies so that they can get rich.

If you are looking for an accident attorney, you are going to ant to do some research so that you can find a responsible and well-respected accident attorney. Here are some questions you are going to want to ask yourself when choosing an accident lawyer.

Number one: Do they respect you as a client and personally?
To answer this question you will need to pay attention when you are talking to the attorney. You want to see if they are paying attention to you when you are explaining your case. You also want to make sure that they have listened to all of your concerns and responded to the concerns that you have had. You also want to see if the attorney is going to return your phone calls in a prompt manner and keep you informed about your case. Some of these things you will not be able to find out when you first sit down with the attorney, but you can still talk to them about the concerns that you might have or switch lawyers later on if things do not work out.

Number two: Do they specialize in handling accident claims?
No matter how good a general lawyer is or how good the referrals are to him, you do not want a general lawyer to handle your accident claims. The reason for this is that laws are constantly changing and a general lawyer might not be able to keep up with the most recent developments in personal injury law, partly because they have, other areas that they have know about. Lawyers that specialize in accident cases are always up to date on the most recent laws, not to mention that the more experience they have in personal injury the faster they can close the case and the more money that they can get for you.

Personal injury claims

A personal injury is described as any harm that is caused to a person. This can be a broken bone, a cut, a severed limb, or even slander. However, in order for you to file a lawsuit to recover damages from a personal injury the personal injury has to be a result of an attack, negligence, or an accident.  The hard part is trying to figure out what your personal injury claim is worth because it will vary depending on your circumstances.

However, if you are involved in an accident that was caused by somebody else their liability insurance company is going to be responsible for certain things. Here are the things that the insurance company or the person liable for the accident is responsible for paying:

  • Medical care and related medical expenses
  • Income that is lost due to the accident from being unable to work or for going in for treatment for the injuries
  • Permanent physical disability or disfigurement
  • Loss of family, social, and educational experiences
  • Emotional damages, including stress, embarrassment, depression, or strains on family relationships
  • Damaged property

When determining your claim the easiest part is adding up the money that was spent to repair or replace your damaged property, the money spent on medical procedures, and the money that you have lost from not being able to work. The hard part is trying to put a dollar amount on the pain and suffering that you have experienced or on any experiences that you might have missed. In order to place a dollar amount on this the insurance companies have developed a damages formula. Here is the formula that they use.

Step one:
Add up the total medical expenses that are related to the injury. This is the base figure that they use to determine how much to pay you for pain and suffering.

Step two:
For minor injuries, the adjuster multiplies the base amount by 1.5 or 2. If the injuries are more severe, the adjuster multiplies the amount by up to 5. In some extreme cases, the adjuster will multiply the amount by 10.

Step three:
Finally, they add any income that was lost because of the injuries.

Keep in mind that this amount is not the final compensation amount; it is the number from which negotiations start.

Number three: What is the lawyer's success rate?
When interviewing the attorney you are going to want to inquire as to how many cases they have won, but you also want to find out what the average award was for each case. This part can be rather tricky because an attorney can make up information to make their success rate look better. To ensure that they are telling the truth you will want to ask the attorney for a list of past clients that you can talk to. Once you have received this list, be sure to contact the clients to see what they have to say about the accident attorney.

Number four: Are they effective at dealing with insurance companies?
Not every accident case is going to make it into court, in fact most accident cases are settled out of court. When hiring a lawyer you are going to want to find out if they are competent enough to deal with the insurance companies and their corporate lawyers. To find out if they are competent you need to ask them for proof of successful past negotiations. If they willingly hand them over to you and everything checks out you will know they can handle the case. If they seem reluctant to pass the information on you need to be wary of them, chances are they do not have very many success stories.

Number five: Do they have trial experience?
Even though most accident cases are not going to go to trial it is still a good idea to make sure that the lawyer you hire has some trial experience. This will ensure that you are prepared if your case makes it all the way to a trial. Not only that, but a lawyer can also sometimes get a case to settle just by threatening to take it to trial. Most businesses will try to settle out of court because it is cheaper for them to settle rather than spending thousands of dollars on a trial that will perhaps bring negative publicity to the company.

Now that you have gotten all of the answers to your questions you can start to narrow down your list of accident attorneys by using some helpful tips. Here are some tips that you need to keep in mind when choosing an accident attorney.

Tip one:
Always try to use a local attorney. The reason for this is that if you hire a local attorney they are more accountable to you. This is because it is harder for people to ignore phone calls from local clients, there is always the thought that they can just walk into the office unannounced. It has been proven that having a local accident lawyer leads to better client satisfaction. Some other benefits to having a local lawyer is there is no long distance phone calls required, the mail communication is faster, and you can schedule an appointment easier. In addition, local attorneys care about their reputation because they are established in the community, unlike television lawyers that advertise to the nation, those people care more about your money than doing a good job for you.

Tip two:
Make sure that you schedule meetings with all of the attorneys that you are considering. This is a good thing to do because most lawyers do not charge an initial consultation fee, this will allow you to determine if there is anything to your case, but let you ask the lawyers a variety of questions. In addition, you will get to see what different lawyers have to say about your case. They should be able to tell you upfront of you have a case, how long the case should last, what type of settlement you can expect if you win your case, and the fees that the lawyer will be charging. The one thing that you do not want to do is make a decision on a lawyer before you have meet with all of them on your list. You want to avoid the lawyers that are giving you numbers that sound too good to be true, you want to choose somebody who is being realistic about your case.

Tip three:
As long as you have meet with all of the attorneys before making a decision, you will be able to decide who is best to represent you based on the likeability factor. If you have not meet with all of them you can still do this, but your choices are going to be limited. You want to keep in mind that when choosing a lawyer you are going to be entering into a relationship, so it will be easier if you get along with your attorney. If you choose an attorney that you do not like or one that does not like you, chances are high that you will not work well together which can end up affecting your case. For example, you dread calling your lawyer so you do not pass on important information in a timely manner. However, you also need to consider the staff's likeability because you will be working with the staff on your case probably more than you will be working with your attorney.

Tip four:
Look at the size of the law firm. Many people tend to think that the bigger the law firms the better the representation that you will get. What you need to realize is that the bigger the law firm is the more attorneys that they will have, which means you might have more than one attorney working on your case. This can create a management problem with your case because of the number of people working on the case. For example, Associate Attorneys often handle the easier parts of your case so that they can gain experience and so that the main attorneys can be free of doing the routine things that go into your case. The main attorneys will simply take your case to court or put the final touches on it for settlement. A smaller firm will have less people working on your case. This means that when you call in with a question you will have a better chance of talking to somebody who knows what is going on with your case.

Just remember that you want to take the time needed to choose the lawyer that is going to work best for you because accident cases are a serious matter. You are going to want to choose a lawyer that will be able to recover enough financial damages for you so that you can cover medical treatments, replace lost income, and help compensate for the pain and suffering that you have experienced.
