What are lemon laws
Lemon laws are laws that
offer a type of consumer protection to people who have purchased cars,
trucks, suv's, boats, RV's, and mini vans that are defective. Lemon laws
differ from state to state. There is also a Federal Lemon Law that can
cover a person no matter what state they live in. If a person's car is a
lemon and they qualify under the lemon law they could get a refund, a
new car, or a cash settlement.
Lemon laws vary from state to state
It is a good thing that consumers have the federal lemon law because
lemon laws vary quite widely from state to state. Some states cover many
types of vehicles and others only cover cars and trucks. For example,
there are some states whose lemon laws do not cover motorcycles or
mopeds such as Arkansas, Florida, Indiana, and Mississippi. Some states
will not cover the dwelling portion of the motor home. And many of the
states' lemon laws specify that their laws cover vehicles that are
mainly for travel on public highways and that carry 10 or less
passengers.
Tennessee, Vermont, and Montana specify that the
vehicles that their lemon laws cover must weigh less than 10,000 pounds.
Some states, such as New Hampshire have a limit of 9,000 pounds and
other such as Utah allow the vehicle to weigh up to12,000 lbs
and they also include motor homes in their lemon law. A state such as
Oregon specifically allows any motor vehicle that is used for family,
personal, or household purposes. And Oklahoma covers both the
mechanically part and the living facilities of motor homes under their
lemon law.
Some states only include new vehicles in their lemon
laws. This may help a person decide whether they would like to risk
buying a used motor home or other vehicle or if they would like to play
it a bit more safe and purchase a new one.
It is very obvious
that what each state's lemon law cover is quite different. It is very
important that a person knows and understands the lemon laws for their
state. It can be very helpful for a person to be familiar with their
state's lemon laws when they are buying a new vehicle.
The federal lemon law
The
federal lemon law, which is also known as the Magnuson-Moss Warranty
Act, is available to consumers who live any state. This law protects
them when they purchase cars, motorcycles, RVs, boats, trucks, and even
many household appliances. The federal lemon law covers mechanical
defects in RV's and other vehicles as well as making sure that the
dealership or manufacturer may have to pay a person's attorney fees if
the person wins in a lemon law suit.
The warranty and repairs
The lemon laws that cover RV's and other vehicles also vary in the length of warranty that the vehicle is covered under the lemon law and the number of repairs that make the vehicle a lemon. Under the federal lemon law the warranty period for the vehicle to be covered under the law is the Manufacturer's Express Warranty plus up to four more years. And if a vehicle has six to eight repairs during the warranty period or three to four repairs for the same defect in the warranty period then the car is covered under the federal lemon law. The specifics for warranty and repairs vary in each state.
